1. GENERAL PROVISIONS
The www.edenhill.ro service is offered by EDEN S.R.L. (hereinafter referred to as "Eden Hill"), with registered office in Jud. Olt, Caracal locality, Str. The entrance to the Museum, registered at the Trade Register under the number J28/15/1993, having CUI RO3375331.
These Terms and Conditions apply in the context of accessing the Website and/or making reservations and purchasing tourist services through the www.edenhill.ro platform, within the Eden Hill Retreat&Spa accommodation unit.
Browsing the website www.edenhill.ro, followed, as the case may be, by making a reservation, is equivalent to reading, understanding and fully accepting the Terms and Conditions below by any User/Client, having the capacity of consumer or professional.
Eden Hill reserves the right to make changes to the content of this website, as well as to these Terms and Conditions, without any prior notification to Users/Customers. In case of disagreements between Eden Hill and Users/Clients, the Terms and Conditions valid at the time of their acceptance by the User/Client will apply.
2. DEFINITIONS
"Platform/Site" - online platform www.edenhill.ro;
"Document" - this version of the Terms and Conditions;
"Client" - any person, consumer or professional, who makes a reservation and purchases the tourist services offered by Eden Hill;
"Content" includes the following elements:
- all the information available on the website www.edenhill.ro that can be visited, viewed or otherwise accessed by using a digital device;
- the content of any e-mail sent to Users/Clients who interact with the Site by Eden Hill by electronic means and/or any other means of communication available;
- any information communicated to Users/Clients by any means by an Eden Hill employee, according to the contact information specified by this User/Client;
- data related to Eden Hill or other privileged data of the Company.
"Distance contract" - the distance contract represents any contract concluded without the simultaneous physical presence of the contractors, with the use of one or more means of distance communication;
"Personal data" - any information regarding an identified or identifiable person ("data subject"). Represents personal data (non-exhaustive list): name and surname of the person, e-mail address, telephone number, etc.;
"Personal data operator" - means the natural or legal person, public authority, agency or other body that, alone or together with others, establishes the purposes and means of personal data processing. Regarding the Website, the data operator is represented by Eden Hill;
"Consent of the person concerned" - any manifestation of the free will, specific, informed and unambiguous of the person concerned by which he accepts, through a statement or through an unequivocal action, that the personal data concerning him be processed;
"Processing" - any operation/set of operations performed on personal data (with or without the use of automated means), respectively: collection, registration, organization, structuring, storage, adaptation, modification, extraction, consultation, use, disclosure, dissemination, provision, alignment, combination, restriction, deletion, destruction, etc.;
"User" - any person who accesses the Site in order to inform and consult the Eden Hill offer, regardless of whether or not they place a reservation for hotel services.
3. GENERAL POLICY
3.1. General provisions
The document establishes the terms and conditions of use of the Site/Content by Users/Clients. The User/Client is requested to read this document carefully in order to prevent any unwanted/unpleasant consequences, which may be assessed by him as having a negative impact on his data and/or the information provided to EDEN S.R.L.
Access to the service is done through the website www.edenhill.ro, by contacting by phone at no. by phone 0733.364.455, respectively by sending an e-mail to [email protected].
By using the Site, the User/Client is solely responsible for all activities arising from its use. Also, he is responsible for any damages caused to the Site and/or the Content made available by Eden Hill, in accordance with the national legislation in force.
If the User does not agree with these Terms and Conditions, he has the possibility to send an e-mail to the electronic correspondence address: [email protected] and specify the reasons and/or the requests to operate the desired changes.
The user can revert at any time on his decision not to agree and/or not accept the Terms and Conditions.
The customer cannot revoke the agreement expressed in relation to the Terms and Conditions during the duration of a Contract or until the moment he pays the counter value of all unpaid Contracts to Eden Hill, respectively the penalties in accordance with the Policy for the application of penalties in case of cancellation/no-show set out in this document, as the case may be.
The name of the Site and its graphic signs are the property of Eden Hill, so these elements cannot be taken over, copied or used without the written consent of their owner/holder.
The entire Content presented or displayed within the Site including, but not limited to: text, graphics, photos, images, moving images, sound and illustrations, etc. is the property of Eden Hill. All
the elements of the services offered by Eden Hill including, without limitation, the general design, are protected by copyright, author's rights and other regulations in the field of intellectual property rights.
The name "Eden Hill"/"edenhill.ro", the logos and symbols associated with it, as well as their combinations with any word, graphic symbol or in any other form, used on the Site, are registered trademarks and are the exclusive property of Eden S.R.L. They cannot be used in any way by third parties without prior consent.
The User/Client may not modify any of the above-mentioned materials and may not copy, distribute, transmit, display, perform, reproduce, publish, license, create works derived from them, transfer or sell information or works contained on the Website www.edenhill.ro.
With the exception of actions permitted by applicable copyright law, the User/Client is responsible for obtaining permission before using any copyrighted material made available by Eden Hill.
Any Content to which the User has and/or obtains access by any means is subject to these Terms and Conditions if the Content is not accompanied by a specific and valid user agreement concluded between Eden Hill and the User and without any implied or express guarantee from Eden Hill with reference to that Content.
The communication of any information or data in the form of a message, text, image, audio and/or video file or any other type of material, regardless of the method of publishing or transmitting them (public or individual), by any natural or legal person, other than Eden Hill, is carried out on the sole responsibility of the person to whom these materials belong, the Company not being in any way responsible for the content or the method of publishing these communications.
In the event that Eden Hill grants the User the right to use, in the form described in a separate user agreement, certain Content to which the User has or obtains access following this agreement, this right extends only to that or those Content defined in the agreement, only for the period of its existence or such Content on the Site or the period defined in the agreement, according to the conditions defined therein, if they exist and do not represent a commitment on the part of Eden Hill for that User or any other third party that has/obtains access to this transferred content, by any means and that could be or is harmed in any way by this Content, during or after the expiration of the user agreement.
No Content transmitted to the User, through any means of communication (electronic, telephone, etc.) or acquired by him by accessing, visiting and/or viewing does not constitute a contractual obligation on the part of Eden Hill and/or the employee of the Company who mediated the transfer of Content, if it exists.
Any use of the Content for purposes other than those expressly permitted by these Terms and Conditions or stipulated in a separate usage agreement, if it exists, is prohibited.
The user is responsible for any damages caused to the Site/Content, in accordance with the Romanian legislation in force.
3.2. Data and contact information
Eden Hill publishes its complete and correct identification data on the Site, so that contacting it by the User/Client is easy.
Accessing the Website, using the information presented within it, visiting the pages or sending e-mails or notifications addressed to the Company may be done by means of electronic communication, by telephone or any other means of communication available to the parties, thus considering that the User/Client consents, in turn, to receiving notifications from Eden Hill electronically and/or by telephone, including communications by e-mail or through the announcements published on Site.
Eden Hill reserves the right not to respond to all requests of any nature, especially if they are unfounded/abusive/insulting, received by any means of communication (electronic, telephone, etc.).
The User/Client expressly declares that the contact data provided by sending them to the e-mail address [email protected] or for making a reservation belong to him (for example: first and last name, e-mail address, telephone number, etc.) and that these data may be used by the Company in its communications with the User/Client, for the purpose of solving any requests, but also for providing additional information, at the request of the User/Client.
4. RATES
All rates displayed on the Site are expressed per night of accommodation and include the "Welcome package", as well as the VAT rate (9%). Rates do not include hotel tax or other taxes imposed by central or local authorities.
Eden Hill reserves the right to change the rates at any time, respecting the rates related to already confirmed reservations, the latter being firm.
The increase in tariffs, at a given moment, may be determined, among other things, by the increase in fees and taxes or in the case of the introduction of new fees and taxes. For already confirmed reservations, the rate will remain the one from the moment of confirmation and will not undergo changes.
5. MAKING RESERVATIONS
Service reservations, subject to confirmation by Eden Hill, are made through the following methods:
- through the online booking platform on the www.edenhill.ro website, RESERVE/BOOK NOW section;
- through the Booking.com platform.
6. PAYMENT AND CONFIRMATION OF RESERVATIONS
The customer has the following payment methods available:
-bank transfer;
- online via bank cards – cards issued under the logo of VISA (including Electron), MasterCard (including Maestro) are accepted.
Reservations are considered completed at the time of payment confirmation.
The customer has the obligation to check the details of the invoice before paying for the services. Making the payment by the Customer has the value of an express confirmation of the related invoice, any subsequent request for modification not being taken into account.
The customer is solely responsible for the correctness of the data entered in the invoicing section of the booking form, Eden Hill having no responsibility for the veracity of the information received and used in issuing the invoice.
7. MODIFICATION. CANCELLATION. FAILURE TO PRESENT. PENALTIES
Any modification and/or cancellation of the reservation of the services, at the initiative of the Client, will be sent in writing to the e-mail address: [email protected], the modification of the services being subject to prior approval.
The reserved services can be canceled as follows:
- without penalties, if the cancellation takes place at least 14 days before the date for which the reservation was made;
- with a penalty of 100% of the value, if the cancellation takes place less than 14 days before the date for which the reservation was made.
No-show is the situation in which the Customer, following a confirmed and uncancelled reservation in one of the previously mentioned ways, does not show up at Eden Hill on the date for which the reservation was made. In case of non-appearance of the Client, the amount paid in advance will be retained in full.
Access to our location can only be achieved with a vehicle properly equipped for winter conditions, we recommend a 4 x 4 vehicle.
8. CHECK-IN & CHECK-OUT
Check-in starts at 16:00.
The details regarding obtaining the access keys to the reserved location will be received by email, after they are finalized online check-in formalities.
Considering that all check-in and check-out formalities are carried out exclusively online, without any physical contact which would allow the verification of the identity data of the person who performs the check-in, we request that together with the online check-in, a copy/photo of the identity document of one of the persons who will stay in the reserved location be uploaded through the check-in interface. We will use the data from the photocopy uploaded by you. only in order to complete the documents specific to the accommodation activity, imposed on tourist reception structures by GD 237/2001 regarding the rules for access, records and protection of tourists in tourist reception structures as well as, in exceptional situations (for example, the occurrence of damages, violation of the rules of use, incidents or disputes), for the documentation of the situation, communication and, as the case may be, the recovery of damages by legal means.
I specify that GD 237/2001 previously mentioned does not require the request of such a photocopy but only the collection of all the data from the identity document, but, considering that both check-in and check-out are carried out exclusively online, without any physical contact with the employees of the Eden Hill Operator, this way of collecting the data from the identity document is the only technical way by which we can ensure compliance with the mentioned legal obligations.
We guarantee the protection of the data provided for check-in and check-out according to the details described in Privacy policy. Moreover, uploading the photocopy of the identity document directly to the check-in application interface where it is taken directly by the employees of the Eden Hill Operator specifically designated to access this information, eliminates the risks associated with its transmission through other means of communication such as email, instant messaging applications, etc.
The release of the rooms (check-out) must be done by 11:00 at the latest.
If check-out is not completed by 11:00 a.m., we reserve the right to charge a 50% surcharge from the value of one night's accommodation.
Exit from the unit must be completed by at the latest at 1:30 p.m. After this time, the full rate for an additional night will be charged.
9. SMOKING
Smoking is strictly prohibited in the Eden Hill premises, with the exception of spaces specially arranged for this purpose.
10. PARKING SPACE
Eden Hill benefits from free parking.
11. SECURITY. SPECIAL NEEDS
Eden Hill does not assume responsibility for forgotten, lost or allegedly stolen objects within the tourist complex.
Eden Hill does not assume responsibility for any accidents that may occur as a result of improper use of the facilities.
12. PETS
Pets are not allowed inside Eden Hill.
Eden Hill has the right to refuse accommodation to Customers accompanied by pets, with the application of a penalty in the amount of 100% of the value of the first night's accommodation.
13. VISITORS
Visitor access is not allowed.
14. ENVIRONMENTAL PROTECTION AND CLEANING
Environmental protection is a permanent concern of ours.
Linen and towels are changed after 2 days of accommodation or at the Customer's request.
15. CONDUCT AND RESPONSIBILITIES
Eden Hill reserves the right to refuse accommodation to Clients who are under the influence of alcoholic beverages or prohibited substances, rude or turbulent who, through their attitude, cause damage to Eden Hill or disturb other Clients.
Customers are liable to Eden Hill for damages caused to other Customers, staff, furniture, equipment, etc.
The customer undertakes not to damage the objects of the tourist complex, otherwise they owe Eden Hill an amount at least equal to the value of the damaged object to which the related labor is added. This clause does not limit Eden Hill's right to obtain full compensation for the damage suffered.
The customer is aware of the fact that the goods from the endowment of the tourist complex belonging to Eden Hill represent premium quality goods.
16. COMPLAINTS
Complaints regarding the quality of the tourist services provided can be made by sending an e-mail to the address: [email protected]. Complaints that can be remedied during the stay will not be considered later.
Complaints regarding the theft, destruction or damage of the goods brought by the Customer to the tourist complex must be brought to the attention of Eden Hill within no more than 24 hours from the date on which the Customer became aware of the theft, destruction or damage of the goods.
17. RESOLUTION OF DISPUTES
Any dispute between the User/Client and Eden Hill will be resolved amicably. If the amicable resolution of the conflict is not possible, it will be resolved by the materially competent courts in Bucharest or Ilfov.
If any of the above clauses will be cancelled, regardless of the cause, this will not affect the validity of the other clauses of this document.
Eden Hill is not responsible for any loss, costs, lawsuits, claims, expenses, etc., if these are directly caused by non-compliance with the Terms and Conditions.
18. PROTECTION OF PERSONAL DATA
Eden Hill attaches great importance to the personal data belonging to Customers or Users. For this reason, it has made available to them both specific information notes and a Privacy Policy that deals with the particularities of data processing when browsing the online platform www.edenhill.ro. We invite you to go through this documentation for more details regarding the rights you have, as a data subject, in relation to Eden Hill.
19. FINAL CLAUSES
Eden Hill reserves the right to make any changes to the Terms and Conditions, as well as any changes to the Site/its structure, including changes that could affect the Site and/or any Content, without prior notification to the User in this regard.
Eden Hill will not be responsible for any errors that may appear on the Site for any reason, including changes, settings, etc., which are not made by the Site administrator.
